Crown Land - Parriwi Park and Spit Reserve

Consultation has concluded

Council has received the following requests for licences and a lease variation of Crown land in Parriwi Park and Spit Reserve East. The lands are Crown lands managed by Council as Council Crown Land Manager under the Crown Land Management Act 2016 and Local Government Act 1993.

Mosman Rowing Club - Parriwi Park

The Club is seeking a temporary licence to conduct development work at the Pearl Bay premises on part of Parriwi Park (R41681) adjacent the existing premises and lease area. The works were approved under Modification Consent 8.2005.467.3 comprising of design amendments to the northern boatshed building and minor changes to the footprint of the building which encroach beyond the existing leased area and occupy a 91.96m2 area of the adjacent reserve. The proposed licence area comprises a 21.97m2 building footprint and 52.91m2 landscaping/access path area to the north, and a 17.08m2 deck overhang to the west. Notice is given under Section 47A of the Local Government Act 1993 of the proposal to grant a temporary licence for approximately two years to facilitate development of the facility.

Upon completion of the development, it is proposed to vary the existing Lease to the Club to capture the completed works and the temporary licence will lapse. The existing 25 year Lease commenced 20 January 2010 and terminates 19 January 2035 with an option for a further 10 year term to 19 January 2045.

Notice is given pursuant to Section 47 of the Local Government Act 1993 of the proposal to vary the Lease by increasing the lease area by 91.96m2 or as otherwise reasonably altered by the Works as Executed Plans following completion of the works, and to vary the rental paid to Council to reflect the increased lease area. Lots 100 and 101 in DP 1231980 will also be amended to accommodate registration of the varied Lease.

Marine Rescue NSW - Spit Reserve East

Marine Rescue NSW is seeking a licence to formalise its long standing and existing occupation of Spit Reserve East (R1013329) for access, parking and other minor purposes (flagpole structure and signage). The use of the Reserve for these purposes is associated with the company’s operations conducted from adjacent premises located on Transport for NSW property which can only be accessed by traversing the Reserve.

Use of this portion of the Reserve under the proposal is substantially unchanged from the current use however, needs to be formalised in view of the proposed development of the premises located on TfNSW land which will be subject to a 20 year lease between the company and TfNSW. The commencement date of the TfNSW Lease is yet to be determined. The proposed licence area is 107m2 as detailed in the plan provided.

Notice is given under Section 47 of the Local Government Act 1993 of the proposal to grant a licence to Marine Rescue NSW for 20 years to facilitate operations from the Marine Rescue premises to commence from the commencement of the 20 year Lease of the redeveloped premises between Marine Rescue NSW and TfNSW and at an appropriate market rent.
